TERMS OF USE

These Terms of Use ("Terms") govern your access to and use of Pixus: AI Video Generator ("Pixus," the "App"), published by TRACODI CONSTRUCTION HOLDINGS JOINT STOCK COMPANY ("we," "our," or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. If you are under the age of majority, you may use the App only with the involvement and consent of a parent or legal guardian.

2. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use, unless you have purchased a plan that expressly permits commercial use. All rights not expressly granted are reserved by us.

3. Accounts

Some features require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us of any unauthorized use.

4. Subscriptions and Purchases

• The App may offer paid features, credits, or auto-renewing subscriptions purchased through the Apple App Store or Google Play.
• Payment will be charged to your app store account at confirmation of purchase.
• Auto-renewing subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel subscriptions in your app store account settings.
• Except where required by law or app store policy, purchases and used credits are non-refundable. Refund requests are handled according to the applicable app store's policies.

5. User Content

"User Content" means any text prompts, images, audio, or other material you submit to the App, and the videos or outputs generated from it. You retain ownership of the content you own and submit. By using the App, you grant us a limited license to process, store, and transmit your User Content solely to operate and provide the service to you.

You represent and warrant that you have all necessary rights to submit your User Content and that it does not infringe the rights of any third party.

6. Acceptable Use

You agree not to use the App to create, upload, or share content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or hateful
• Infringes any intellectual property, privacy, or publicity rights
• Contains sexually explicit material involving minors, or is otherwise exploitative of minors
• Impersonates any person or entity or misrepresents your affiliation, including creating deceptive deepfakes of real people without consent
• Contains malware or attempts to disrupt or compromise the App or its infrastructure
• Violates any applicable law or regulation

We reserve the right to remove content and suspend or terminate accounts that violate these Terms.

7. AI-Generated Content

The App uses artificial intelligence to generate videos and other outputs. AI-generated results may be inaccurate, unexpected, or may not reflect real events. You are responsible for reviewing outputs before using or sharing them and for ensuring your use complies with applicable laws. Similar or identical outputs may be generated for other users.

8. Intellectual Property

The App, including its software, design, trademarks, and all related content (excluding User Content), is owned by or licensed to TRACODI CONSTRUCTION HOLDINGS JOINT STOCK COMPANY and is protected by intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works from the App except as permitted by law.

9. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, TRACODI CONSTRUCTION HOLDINGS JOINT STOCK COMPANY and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the App.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if we discontinue the service. Upon termination, the licenses granted to you will end.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-law principles, except where mandatory local consumer protection laws apply to you.
